- How can foreigners buy real estate in the Czech Republic?
 According to
Czech Law, foreigners and foreign companies are not allowed to purchase real
estate in the Czech Republic. However, a foreign person or entity can own a company. Thus, the most common method of acquiring real estate is
through the establishment of a limited liability Czech company (s.r.o) which is
a relatively simple and inexpensive task. This company then purchases the real
estate. An s.r.o. can be established in 3-4 weeks.
- What are the tax implications of acquiring real estate?
According to the
tax law the seller is liable for a property transfer tax of 3 % - § 15 zákona
357/1992 Sb. The buyer becomes liable in the event that the seller does not pay.
If the real estate is acquired through a company then the company will be
subject to Czech corporation tax on net taxable income. The rate of this tax is
31 percent. There are many tax-deductible items that can be used to reduce
taxable income, including depreciation of the capital cost of the building,
interest charges etc.
- How is ownership proved?
Each buyer should perform adequate due
diligence in order to check the title of the property. In Prague there is a
central registry of ownership known as the Kadastral. This institution holds
records of ownership, mortgages, liens etc. It is the most useful first step to
determine the ownership of the real estate.
- How does the purchase contract/process work?
The process of acquiring
real estate is well established. Buyer and seller negotiate conditions.
Typically, the purchaser will lodge the purchase price in a notarial or escrow
account to which the seller will have access only after the Purchaser is
registered as the new owner.
- Will I need a lawyer?
Yes. It is likely that documents will be in the
Czech language and you will need a lawyer to represent your interests.
- Can I borrow money using the building as collateral?
Many owners use
their buildings as collateral for bank loans. Your ability to do so will depend
on your banking relationship. Typically, local banks will lend up to a maximum
of 70 percent of market value, in the case that there is an adequate income
stream on the building.
- If I buy a building with regulated tenants is it possible to vacate the
property?
Yes, although this is a matter of some negotiation and cost. It is
the obligation of the owner to provide alternative accommodation (or money) for
the tenant. Generally, it is possible to come with a reasonable solution with
individual tenants, although this is not guaranteed for every tenant in every
building.
- If I want to reconstruct a building, can I do what I want regarding design?
Absolutely not. The Czech authorities are very concerned to maintain the
beauty of Prague and all reconstructions in the historic area of Prague are the
subject of agreement with conservationists, who must approve all major changes.
- If I buy a building and I live abroad, how can I manage it?
You can

- Can I rent the property at western rents in Prague?
